This Acceptable Use Policy (AUP) sets out the standards for use of Nexiva AI's website, services, and any automation systems we build and deploy on your behalf. By using our services, you agree to comply with this policy.

1. Permitted Use

  • Using our services for legitimate business automation and operational efficiency purposes
  • Automating workflows that comply with applicable laws and regulations in your jurisdiction
  • Accessing our website for informational and business purposes
  • Using delivered automation systems as documented and trained by our team
  • Sharing access to automation systems with authorized personnel within your organization

2. Prohibited Activities — General

  • Using our services for any unlawful purpose or in violation of applicable laws
  • Attempting to reverse-engineer, decompile, or extract source code from any system we build
  • Reselling, sublicensing, or transferring our services or deliverables to third parties without written consent
  • Using our website or services to transmit spam, malware, or malicious content
  • Impersonating Nexiva AI or our team members
  • Using our services to harass, harm, or defraud individuals or organizations

3. Prohibited Automation Uses

  • Automating the sending of unsolicited commercial messages (spam) in violation of anti-spam laws
  • Using AI copilots to generate misleading, false, or defamatory content
  • Building automations that scrape websites in violation of their terms of service
  • Automating processes that violate the privacy rights of individuals without proper consent
  • Using our automation infrastructure to conduct denial-of-service attacks
  • Automating unauthorized access to third-party systems or accounts
  • Using WhatsApp automation in violation of WhatsApp's Business Policy

4. Data Handling Obligations

  • Only process personal data for the purposes disclosed in your privacy policy
  • Obtain necessary consents before collecting or processing personal data through automated systems
  • Ensure automated communications include required opt-out mechanisms under applicable law
  • Maintain appropriate security for data processed through automation systems
  • Notify us promptly if you become aware of a data breach affecting systems we built

5. Content Standards

  • Any content used in automated messages, AI training, or workflows must not be defamatory, obscene, or discriminatory
  • Automated communications must clearly identify the sender and not misrepresent origin
  • AI-generated content used in customer communications must comply with applicable disclosure requirements
  • You are responsible for ensuring content used in your automations does not infringe third-party intellectual property

6. Resource Usage

Where Nexiva AI provides shared infrastructure or platforms, use must not unreasonably burden system resources, interfere with other users, or exceed agreed usage limits. Excessive usage may result in service throttling or additional charges.

7. Compliance with Third-Party Terms

When we integrate third-party platforms (WhatsApp, Slack, Gmail, CRMs, etc.) into your automation, you are responsible for ensuring your use complies with those platforms' terms of service. Changes to third-party terms that affect your automations are your responsibility to monitor.

8. Consequences of Violation

Violation of this AUP may result in immediate suspension of services, termination of your service agreement without refund, requirement to indemnify Nexiva AI for any resulting costs or liabilities, and reporting to relevant authorities where required by law.

9. Reporting Violations

If you become aware of any violation of this policy, please report it to contact@nexiva.dev. We investigate all reports and take appropriate action.
